Can I refuse to hire an employee who

will require sponsorship?

If you mean that the applicant currently lacks US work authorization, you have no obligation to proceed with the extremely expensive and lengthy process to apply for Dept of Labor certification and then a visa.

If you are referring a sponsorship under the immigration law, no you are not required to hire them. In fact you cannot hire them until they actually have the work permit.

If you want to go through the process, I can refer you to an immigration attorney who only represents employers in getting work permits for employees.
