Legal Question in Business Law in Massachusetts

My manager was late approving our commission because she was off on the last day of the month. Now our commissions won't come until our next paycheck. I asked for a separate check right now for the commissions and she said no even though this has been done in the past.

From what I am reading Commissions are to be treated as wages in Massachusetts which are to be paid within 6 days of the end of the pay period. These commissions are definitely determined, due and payable. Is this correct? I want to talk to HR but, want to have my facts straight because the HR manager and my manager are freinds

Technically, a wages including commissions are to be paid within 7 days of due date. So yes you can go to the HR dept. I would be cautious in dealing with this issue. Even if you are correct in your position, you do not want to damage your relationship with your supervisor or your company. So I would make the point of the requirement of payment but ask for the courtesy as you need the money for X, e.g. pay taxes.
