Termination of Employee

I own a Massage Therapy Business. I have over 8 Therapists working for me. I have one therapist that has refused to work thier designated shift. She has refused to come in due to health issues, habitually late, and various other reasons. Can I just terminate her without worry about Work Comp. or anything else.

your problem is more of an employment law issue. If her health issues are unrelated to her job, then Workmens comp should not be the issue, that does not mean she will not make a claim.

If her health issues relate to something that could be considered a disability, you could have a problem simply discharging her.

I would suggest you contact an employment law attorney as soon as possible.
