Legal Question in Civil Rights Law in Massachusetts

Hello i have been going through a divorce for over a year. The hole way through a have been 100 percent behind him, even tho there were times that we did not agree on some things. I am 5000.00 paid and owe 3000.00 at this point With that said the were ordered to have a four way meeting and my lawyer lost it. We were going through the paper work updating it and he is yelling at me at the ex wife and the other lawyer. Now my lawyer has told me on several acation that he dose not like her lawyer and dose not think she know what she doing. So this is a divorce we are not going to agree on everything so there was some talking back and forth. So after almost an hour of breaking the paper work down so that it works for both of us. He yells and kicks all of us out of his office. why because he had another appoint right after mine. So then the ex and lawyer leave they are pissed that he called us all down there to his offices and kicked us out. Now if he would of told us that we only had a hour we would of been quicker but he did not. So his partner was there in the office and i ask him what the hell just happened and he said give him some time he will call you soon. That meeting was a week before our court date. So i wanted for him to call he never did so the day before court I sent him a email Hi Lawrence I thought i would of heard from you by know. What happen Wednesday was not only unprofessional but down right rude. You invite her lawyer over to a meeting then you kick all of us out. Because you have another meeting, Well if you did not know that made me feel like crap and not important to you as a client.

What is the game plan, you know i cant afford do this anymore. I need to know from you what is going on. What is the goal for tomorrow, i need to take care of the day care thing one week one week work fine. I need to here from somebody today?

then he sent this back

Joe will be there to cover your case. I have filed a motion to terminate my representation of you. I am waiving any past due fees you owe me and wish you luck

Then the next day in court he gave me the paper work that he wanted to be touring off the case. The gouge said no to the request and said he dose not want this case to go to trial because there is no money no house no cars. I have a court date on June 6 and i still have not heard from them

1 Answer from Attorneys

Christopher Vaughn-Martel Charles River Law Partners, LLC

This attorney's conduct sounds extreme and inappriate, and it sounds like his business partner knows it. An attorney will typically not be allowed to withdraw days before a trial.

It is hard to tell by your question what you are looking for. It sounds as though there really isn't much money or property to be divided, and the parties simply need to sit down and work out an agreement.

The attorney may be frustrated if the parties continue to fight without the financial resources to do so. Regardless, his behavior sounds unaceptable. Unfortunately, you need a new attorney. Please feel free to contact our office if you would like to see if an agreement can be reached on your behalf with your spouse's attorney.
