IM messages -used for legal proof?

From question on 6/20/09 in mass:

**1. Can im messages be used by police & court to prove mother's role in allowing, encouraging underage sex?

**2. Can im messages be used if states that mother plans on lying about her & her daughter's role to police & in court & will put blame on 15 yo boy?

**3.Can im messages be used to prove that 13 yo girl not 15 yo boy was the instigator in pressuring, taunting, threatening,stripping on webcam for boy to have sex (for months)?

Yes, they would likely be admissible. However, you should consult with a criminal law attorney regarding the legality of obtaining the IM messages in question as there is a law prohibiting taping of telephone calls in MA and I am unfamiliar with the possible scope of that law as it applies to electronic messages.
