Legal Question in Consumer Law in Massachusetts

Internet Fraud

About a year ago I purchased exotic animals from a breeder I

found on the internet. After signing the contract I sent a cashier's

check to the company and waited for the ship date to arrive. The

location they were coming from was hit hard with snow and it was

agreeed that I would receive new baby animals a few months later.

Never happened. I was then told I would receive new ones this

past December/ January, the business is still around but will not

respond to my emails or voice messages and they still have my

money. Is small claims the only way to try and collect? I can file a

complaint for internet fraud but do I try to collect the money first?

The company has already told me they will only give me half my

money back which is why I had to keep accepting the new ship

dates of new animals.

Re: Internet Fraud

Massachussetts has statutes to protect consumer from unfair or fraudulent acts. Those statutes provide for doub or treble damages as well as the recovery of attorneys fees. Please contact me if you wish to discuss this further.
