Legal Question in Consumer Law in Massachusetts

First Right of Refusal

The seller in Ohio offered for sale his boat in Massachusetts. I contacted him to express interest but not at the full asking price of $3900. He stated that I was that first interested party and that he was not willing to sell for less than the asking price of $3900 at that time but would give me a first right of refusal. He later contacted me and stated that he had other parties interested in examining and possibly purchasing the boat. Before the other parties examined or purchased the boat I offered to purchase the boat for the full asking price of $3900. He refused to sell the boat to me. is there legal recourse in this situation?

Re: First Right of Refusal

Sure, you could sue this reneging seller for breach of contract, but one major issue would be: what are your provable losses or damages which are attributable to the breach?
