Hi I was behind on my truck payment business has been bad but i need the truck for work, so anyway i called the bank to see if we could make a deal to bring it current, I was told to make a cash payment for 2 of the 3 months that i had missed this is now 3:30pm on friday, well i got to my bank and it was closed I could not withdraw the cash to make the payment, I had to wrk saturday so i made the cash payment on Monday, I called the bank and know thw snotty little man said oops to late we told you to make the payment friday night, I explained what had happend but he did not want to help, now he goes on to tell me guess what I know want 2 more payments in 2 days or I will repo the truck? I said it's only behind 1 he told me '' be a mna and pay your bills you looser'' I almost fell off the chair, what should i do ? thank you.

Hi,

That is in violation of the FDCPA. I would ask to speak to his supervisor. I would also file a complaint with the A.G.'s office. You have legal recourse, and I would suggest contacting a lawyer.

Repossessing vehicles by creditors within the Commonwealth is governed by the Massachusetts Motor Vehicle Installment Sales Act.The bank must follow the rules and regulations promulgated by that act or they will be liable for damages. One of these rules mandates that the creditor or collector give the debtor a "right to cure".
