Legal Question in Credit and Debt Law in Massachusetts

My son was scammed tyring to sell his guitar on line. He cashed 2 counterfeit checks each for $720.00. The local bank called one week after he cashed the second check and almost 3 weeks after he cashed the 1st check to tell they were counterfeit and that he needed to repay the bank.

He is 20 and working but has $70.00 in his bank account.

Shouldn't the bank have some responsibility for accepting the bad checks and cashing them?

Is he legally responsible to repay the full amount?

Joseph Murray Joseph M. Murray, Esq.

Yes, he must repay the bank. His action is against the person(s) who gave him the bad checks either by contacting the police or the clerk magistrate of the local district court seeking issuance of a criminal complaint for larceny by fraudulent check(s) or by bringing a civil action in the small claims department of the same court. Good Luck!
