Writing Bad Checks

What is the law regarding passing bad check in MA. Can a company take a person to court and is there jail time a possibility?

It is a criminal offense to knowingly pass a bad check. The state district attorney would be the person to bring criminal charges against you for passing the bad check. The company receiving the bad check may sue you in civil court to collect the debt which was not satisfied by the bad check. A company may not bring criminal charges they could only contact the D.A. and it is up to the D.A. to bring criminal charges.
