An 18 year old charged with Statutory rape

An 18 year old is charged with statutory rape of a minor.There was no violence involved. The two have been dating for a few months. The other is 14 years old. The 18 year just graduated high school in may. They were in school together but did not start to date still after may. The 18 year old has no previous records. Good student, no trouble with the law or school. The 14 year old is promiscious. The 18 year old was a virgin. Is there a chance he may not go to jail?
