Legal Question in Criminal Law in Massachusetts

Assaulted in home

I was sitting in my home and four people walked in. As the door wasn't locked and demanded that I tell them were my best friend was. I refuwed they broke furninture and started shoving me. My sister, her 2 yr old son and a friend were in the house with me.

They came back in and found me on the phone warning my friend and the 26 yr. old started beating me. I called the police and they said there was nothing other than taking a report they could do. I am 17 and she is 26 and since no weapon not a home invasion.

Is this true I have no legal recourse to protect myself and prosecute?

Re: Assaulted in home

Call the police and ask that an officer come out to observe the broken furniture. The fact that the door was not locked does not permit others to come in. This is a break and enter to commit a felony, or at least a misdemenaor. It sounds like the police do not believe you. Is that the case??

The police should pursue this. Can you provide names of the people who broke in? Descriptions?

If this ever happens again, just call 911.

Re: Assaulted in home

Wrong!

Call the chief of police, any selectperson, and if that does not work, call the local office of the district attorney; and as a last resort, you can file a request for a complaint at the district court; you can also sue these people in civil court.
