My question is what might I expect this person to receive for jail time, if I press charges? I received a broken ankle tib fib fracture. Had sugery, ended up with steel plate and screws in my ankle. Hi,

Your assailant's sentence depends on many factors that make it diifficult to predict. You may want to seek a restraining order. Please call me to discuss this matter, free of charge, at 617-500-3694.

The answer depends in large part on his prior criminal record, if any, and any mitigating circumstances that he might raise, like self defense, etc. If the case is brought in the District or Boston Municipal Court, the maximum sentence is 2.5 years. If the case is brought in Superior Court, the maximums may be higher if a weapon of any kind (including a shoe) was used in the incident.

I assume you are in contact with the police.

You may also be able to sue him civilly to recover for your medical expenses.
