Legal Question in Criminal Law in Massachusetts

My boyfriend is being charged with assult

I wanted to ask how serious is this charge? About 6 years ago my boyfriend seperated from his then wife, he found out she had been cheating with his cousin and had children with his cousin, children that he thought were his, but anyways when he went to his then wifes house to pick up his children (who then he thought were still his) he found his cousin there with his ex. My boyfriend and his cousin had an altercation, the cousin touched my boyfriends arm and my boyfriend hit him,Now 6 years later the cousin his pressing charges of assult. My boyfriend is due to go to court 3/23/06. Should we be worried and how serious is this?

Re: My boyfriend is being charged with assult

The maximum penalty on an Assault and Battery charge is 2 1/2 years committed to the House of Correction. There are many other possibilities for resolution of a case including but not limited to probation, suspended house of correction sentence with probation, pre-trial probation and dismissal. I would recommend that you speak with an attorney about the possibilities and the strength of the Commonwealth's case. An attorney is obviously going to be able to get a better result for your boyfriend than if he were to go at it alone. Please feel free to contact me further. Martha Kovner
