Legal Question in Criminal Law in Massachusetts

harassment

if i am being continually sworn at and being called very insulting names by a man who acts in a very threatening manner as i drive by his house (even when my 12 yr. old son is with me) and the police brush it off because the man denies it, can i legally tape record these incidences if the man knows he is being taped?

Insulting alone, from what you describe, is not a criminal act. You cannot tape without permission. However, in public you can probably video tape the action. I do not understand what you mean by threatening manner???

The answer is yes. You can also go to the Clerk's Office of your local District Court and request to file your own Criminal Complaint. You don't have to rely on the police. You will have to know the man's date of birth and Social Security Number so the man's Probation Record can be checked. Keep trying through the police first. Try filing yourself as a last resort.
