Legal Question in Criminal Law in Massachusetts

hypothetical question how long before should go to court? someone was in a car that got stopped
by the police after a drug buy,the police took the passenger out of car read them their rights but
did not take driver out and drive also told police how much he paid and it was in plain site in the car,
the passenger was never in the court system at all, and now after 1 week the police officer is saying
that they will just recevie probation and fine is what they say true or does the person get arressted
first? and as far as driver it seems that nothing is going to happen with the driver at all?
