larceny by false pretense

I purchased

CDs from the record club and resold

them on line. I could not get enough

in my own name as they had limits

so I made up names. I did pay for all

of the CDs until the record club would

discontinue an account. There was

no closing statement and they would

not respond to me so I opened new

accounts and had them shipped to

post office boxes in my name, all paid

for.

As i did pay for the CDs is it larceny

to purchase them under assumed

names. That is what I am being

charged with.

Is it the record clubs responsibility to

send me closing statements and ask

for money if they feel I still owe them

any?

Is this case criminal or should it be

considered civil?

Let me get this straight... you used fictitious names to induce a seller of goods to ship you discounted merchandise through the U.S. Mail; resold these items online, and you are asking whether this is criminal? Are you being charged in the State Courts (Larceny over $250), Federal Courts (mail fraud at a rate of 1 year per count), or both since they are separate crimes? You need a lawyer.
