Legal Question in Criminal Law in Massachusetts

Marijauna...Felony?

I was pulled over and an officer found a couple grams of marijuana and a pipe with resin my pocket. I thought it was a misdemeanor but my court papers have a box checked with the words ''charged with one or more felonies, i request a hearing.'' what is the felony? my charge is poss class D. and under variables it says resin in pipe. What could happen? first offense. i also got uninsuered, unregisterd vehicle, but dont think those are felonies either. Thank you.

Re: Marijauna...Felony?

None of those charges are felonies in MA. However, do not treat them lightly because they are misdemeanors. The possession of marijuana, although a misdemeanor, can still carry collateral the consequences of a loss of license and no financial aid if convicted. Also, subsequent offenses raise the stakes so it is always good to fight a 1st offense whereever possible so that each charge is a 1st offense.

It doesn't sound like there are any felonies charged from what you have said, regardless it is good that you are eligible for a clerk's hearing. If you need an attorney to represent you, please see the number below or check out my firm's website.

I agree.

Usually, if you have no record, the disposition is simple. I agree with Jessica that you should have the police report reviewed by a criminal defense attorney, and if you want, you can contact me.
