Legal Question in Criminal Law in Massachusetts

MV Stealing parts

my son was arrested for taking and stealing mv parts, they said they have him on video...he recently received two more charges in the mail. one dated for 2003 and one dated for 2004, they said they got his fingerprints for these two incidents as a result of the current arrest. He is being charged with B&E of a truck, larceny over $250, malicious damage to property.and additional charge of taking and stealng mv parts. Can you tell me what the punishment is for these and what amount of time he may be facing? He has no prior convictions, but he does have a prior continued without a finding which has since dissolved. Also, he can't afford an attorney, will a court appointed really be able to provide him the support he needs. anquished mom...

You are not telling me if the charges are pending in the same court.

Given the little that you said, he may be at a minimum, looking at a suspended sentence or worse.

It depends on the quality of the attorney, not something else.

Contact me if you or your son need assistance.

Assuming the charges are in District Court your son is facing a maximum charge of 2.5 years on each count. However, there is a good possibility he has solid defenses to these charges. Depending on the court, and some other factors, your son is probably looking at a probationary period, possibly with a suspended sentence if he plea bargains. If he loses after a jury trial, it is likely that he will do some time in the House of Correction. I warn you though, that it is really impossible to say without knowing all the facts.

Court appointed attorney's are generally good. There are some that are horrible and some that are fantastic litigators. It all depends on who you get. One good thing about court appointed attorneys is that they are very familiar with the judges and DA's in the court and can therefore usually work out acceptable plea bargains.

Good luck
