Violence Domestic

After the 5th time of having charges of a domestic violence with the same person that you are legally married to and the wife decides to drop once again the charges would the state take over the case since it has been asualt and battery with a dangerous weapon? or can she just drop the case with no problem

The state may well decide to take over the case.

Your suspicions sound well grounded. After 5 previous times that the wife has dropped the charg4es, the state is likly to try to prosecute with or without her cooperation. I would not count on the DA merely dropping the complaint at her request if they have evidence that can go forward with.
