Legal Question in DUI Law in Massachusetts

I received a marked lanes violation civil ticket before being arrested for oui. When I asked my defense attorney where the ticket figured in the whole thing, he waved me away and said "i don't know send it to the registry." Given what i've seen in my own research, this shows she doesn't have the first clue what she's doing. Am I right about that? Thanks

You are correct, a civil penalty that accompanies a criminal charge is handled as part of the criminal case. It will/should also likely be the subject of a Motion to Suppress.

An OUI is a serious charge and has life long implications. You need to trust the attorney that is representing you if you want to have any shot at obtaining the best possible outcome. Try and reestablish the lines of communication with the attorney. If that doesn't work shop around.

Your attorney should have advised you that the citation is part of the OUI-the police needed a reason to stop you and that was the reason-which it always is. The ticket should be included in the OUI charge for procedure only-you dont need to send it to the registry if its in the OUI charge. You need to trust your attorney but if he/she is not able to defend you then you need to find one that can or you stand a lot to lose-774-745-0562.
