Legal Question in Elder Law in Massachusetts

Elder Guardianship Bank Accounts

I just recently rec'd temporary guardianship over my Mother. This allows me to add my name to her bank accounts? Once I add my name is there any restrictions to withdraw money from the accounts?

Re: Elder Guardianship Bank Accounts

You must present a copy of your appointment to the bank, at which point you should be listed as the guardian, not a co-owner. Once you are on the account, you may only use those funds to pay for your mother's bills. I STRONGLY encourage you to hang on to receipts, copies of canceled checks, and other documentation which will be needed to prepare the required accountings. Any gifts or transfers of funds or other assets to you or another family member must be with permission of the court.

Please feel free to contact me if I can be of further assistance.
