Legal Question in Elder Law in Massachusetts

Can an elder sell her house to her children and then gift money to different children up to a certain amount, pay them for caregiving and not have gifted and caregiving monies included in elegibility for Medicaid? How is the lowest credible fair market home value determined? The property is unencumbered.

The gifts made to the children will be included in the 5 year look back rule. I suggest you contact an attorney who deals with Elder Law issues to determine what options are available to you.
