Legal Question in Elder Law in Massachusetts

My grandmother gave power of attorney to my aunt. She was given permission to look over my grandmothers affairs. My aunt has access to all information of my grandmothers.

Before my aunt passed away, she transferred my grandmothers property to to her son.

My cousin was her executor of her estate.

He put the property in his name and is about to sell the land.

My grandmother is heart broken that her property is being sold right from under her is there anything that can be done? The property is located in North Carolina where my grandmother lives .

I am sorry to hear about your situtaion. Everything is based off how the power of attorney reads. Without reading the document it is hard to give a real opinion. If your aunt had the right to transfer the property, she may have been well with in her power. But, one can not tell without reading the power of attorney.

You need to contact an attorney in North Carolina and file suit against the estate of your aunt and your cousin for breach of fiduciary duty and failure to act in the best interest of your grandmother. Good Luck
