Hello,

In order to start custody proceedings you need to file a complaint. Depending on what your situation with your child's father is (whether you were married and whether there is currently an existing custody order) you will need to file a complaint for divorce, a complaint for custody or a complaint for modification.

Custody is awarded to the person who serves the best interests of the child and there are several factors that a judge weighs prior to determining who the proper custodian of the child is.

I suggest if you do want to move forward with your custody case, you retain an attorney. If you are interested in retaining an attorney you can contact me at (978) 276-0777 or [email protected] to schedule a free consultation.

Thank you,
