Legal Question in Family Law in Massachusetts

appearance n court out of state

If I have received a summons to appear for a request for modification and I live out of state. Due to high costs of flights and other children at home I cannot attend. I replied to the complaint and mailed it certified mail return receipt and also explained my reasons for not appearing. Do you think that is ok? Can I have a family member in Massachusetts appear for me. The compalint for modification is not for a minor child but rather our child that is over 21 year old.

You should hire an attorney and not a family member to represent you in the Mass. Court.

Unfortunately, the action lies where the child lawfully resides.

The reply to the complaint should have been sent to the court, with a copy to the person or their attorney who filed for modification.

You have not related the reason for modification, where the child is over 21. Such information is essential.
