child passport

I am a single mother of a 4 year year old boy. My sister and I and my son planned a vacation to cozumel, mexico in april. I need the fathers signature to obtain a passport for my son. He never sees my son , he doesnt pay child support..he doesnt even have a job...and hes refusing to sign . Is getting sole custody my only option in this case?Is there anyway I can go around that for the time being and start that after I get back or while Im waiting for the passport??

You can file a Petition with the Court asking they order him to pay child support and allow you to obtain a passport for your child, including that he sign whatever documents that are necessary.

the court is likely to allow you and your child and sister to take a vacation to Mexico.

I am assuming that you were not married to the child's father. IF there has never been a court action regarding this, you should file a complaint to establish paternity and then a motion for the court's permission to take your son out of the country. The court will most likely give you permission. Furthermore, with a Complaint to Establish Paternity, you will be able to get child support for your son.
