child support but married

My husband asked me for a divorce 3yrs ago, butnever went thru with it. He is now living with a nother woman and giving me and his son(17yrs) $80 a week. Can I go to court for child support and still be married? I do noy have the money to file for the divorce myself ... but my son should not have to sufer for lack of support . Please help me

Two available options are to consult an attorney about filing a divorce or a separate support action with a motion to require your husband to pay all or part of the fees and or explore your eligibilty to do so in forma pauperis where you ask that filing fees be waived if you can file an accompanying affidavit of indigency.
