Do I need to ask the courts to agree to me and my daughter moving out of state if ex and I have 50/50 custody.

Once a case is filed in court for either a divorce or paternity then both parents need permission of the other parent or a judge before they can remove a child from Massachusetts. The easiest and quickest option is to ask the other parent for permission. A move out of state may require changes to the parenting schedule and possibly child support as the cost of long distance visitation is a factor that can be considered for an adjustment to child support. If the other parent doesn't agree then you need permission from a judge.

This requirement continues after divorce or paternity judgment is final.
