Legal Question in Family Law in Massachusetts

I am divorced. My former wife and I are back in court regarding our individual contribution for our daughters college education.

My question is regarding her financial statement. She recently ( as of 3 months ago) cashed out on a 401K retirement account. Would that be counted as income on her 410 financial statement? She also has a live in boyfriend who is paying her $1000 a month. Although she states on her financial statement that he is not paying rent. I have documented proof which consist of a copy of her boyfriendd's 410 financial statement he submitted to the courts a month ago. His 410 financial states that he is paying $1k in rent to my former wife. Do I have any recourse?

Yes, all this information should be presented to the court to show that your wife has the ability to contribute to the child's education.
