Legal Question in Family Law in Massachusetts

Equal protection for stay at home dads

I am a totally disabled man. This is not disputed. During the term of my disablity my wife had two children. She worked before, during and after the pregnancy.

I was the homemaker, In june 1998 my wife got a 209a order agains't me based on fabrication and exagerations. There are no allegations of violence.or child abuse. She want a divorce. Glc.209a grants the plaintiff custody of the children.

My position is that I'm entittled to the same rights as any women in my case, like the average house wife. My position is that 209a fails to meet contitutional viability as the levels for employment of the restraining order are to low.

without the 209a I don't think the court would have taken my children from me during the litigation. I believe I have been denied Equal protection because of my gender. Does anyone know of any case that would support my position. There are no problems with the children10 and 12 I can see them every day at childcare ,when they go and have them every sunday and can call when I want

I appreciate your time and considerations of this question, I am pro se I can't afford a lawyer, she has one, I have beaten her on several motions thank you for you help
