Legal Question in Family Law in Massachusetts

My exwife and I have been divorced for 20 yrs my name is still on the mortage in the divorce seattlement I was to turn over the deed which I did and had no financial responsibilitys to the mortage. I"m trying to have my name removed so I may purchase a home. The bank says that she need to write a letter releasing my name from the mortage. She refuses to do so. What would be my next step.

Depending upon the terms of your seperation agreement; you may be entitled to petition the probate court where you were divorced and seek a modification or a contempt complaint seeking your name's removal from the mortgage.

I would start by speaking with your original divorce attorney, assuming he is still practicing.

Next step is to request to have the divorce court (probate & family court judge) ORDER your ex-wife to complete the paperwork.
