I have legal and physical custody of my 13year old daughter from my first marriage. Her mother has legal custody and is obligated to pay$95 a week in child support. Due to financial difficulties she stopped paying and it has been brought to my attention that she is in deep debt. My question is: If the mother dies would my daughter inherit her debt and would I become responsible? What actions should I take,if any? Should I talk to a lawyer? Thank you very much!

Your daughter does not inherit debt. Debt would be paid only out of your ex's estate, if any.

You should seek help in getting your ex back on line with child support, via a contempt action. Child support is a priority; the other debts get put behind it by all courts (including Federal Bankruptcy). For more information, or to contact me, please view my website at www.gregleelaw.com.
