Legal Question in Family Law in Massachusetts

My husband and I are separted....but not legally. The first mortgage is in both our names and I'm paying that with his child support he gives me. The 2nd mortgage is in his name only. The 2nd mortgage hasn't been paid in over 1.5 yrs and now they are calling him. He claims he's not paying it because he doesn't live there anymore. I understand that it could go into foreclosure but isn't he legally bound to pay it since it's souly in his name???

Unless there is a court order requiring him to contribute, you are out of luck. You need to file a complaint for divorce and seek an order forcing him to contribute.
