Legal Question in Family Law in Massachusetts

My husband has a ten year sentence and he has served five years of it. I am ready for my divorce, however, during the time of his incarceration, I have gained a stock portfolio that is worth some significant money. Does he automatically get half of that eventhough he was in jail during the time I gained this asset?

No. He does not automatically get half. The court will balance all the facts and determine what is fair. A number of factors are relevant including how long you were married and how much each side contributed to the acquisition of assets during the marriage, amongst other things. No MA is an equity state and the judge will balance all the facts to determine a fair settlement. You should contact an attorney sooner than later.
