Legal Question in Family Law in Massachusetts

I have legal custody, permanent guardianship of my niece until she turns 18. This was set up by the courts through DCF who had custody of her for 2 1/2 years (in our home as a foster parent). We were granted a monthly stifen (payment for her) and Medicaid as a secondary to my health insurance until 18. Now her birth father has decided to cover her under his health insurance which has caused alot of issues. Is there a law in Massachusetts stating that I can have her removed from his insurance policy? His union rep stated that he is her eligible dependent and she cannot remove her. She will still be on two other policies? I have asked DCF and they have not idea.
