Legal Question in Civil Litigation in Massachusetts

My fiance recently moved out of our apartment, taking with her all of what she considers her personel belongings.( Furniture, clothing, etc.) She took with her the engagement ring and diamond enhancement ring. These rings were given as a promise to wed. They were not given as a gift.(Christmas present, Birthday present, Valentines Day present etc.) These rings are valued at over 5000 dollars. we had been engaged for approximately 2 years with no date set for nuptials.(Mutually agreed upon.) What recourse do I have in recovering these rings?

Based on what you've said, you have good recourse. If your fiance refuses to return the rings voluntarily, you could commence a lawsuit in small claims court to recover them. I don't know what kind of speaking terms you are on, but at some point, if I were you, I would send her a certified letter, explaining your rationale for asking for the rings back (i.e., the rings were a conditional gift, based on a promise to wed), and giving her a reasonable deadline to return the rings to you. If she refuses to return the rings after that, then I think you would want to consider starting the small claims case. Good luck.
