Legal Question in Civil Litigation in Massachusetts

Representation

Can an employee of a municipality who is a lawyer represent the town in a civil action in Superior Court if the employee's primary job with the town is not as an attorney? If not, where can I find a reference for this rule?

Your question is whether this is a conflict of interest, I believe. If the lawyer is not a necessary witness, or a reasonably likely witness, the town certainly can vest him or her with appropriate authority to represent the town.
