Legal Question in Civil Litigation in Massachusetts

Being Sued for $. Say I owe $ I don't

I sold an industrial building to a buyer for much less than it was worth so that I could remain on the first floor with my material rent free for two years. Some terms were agreed to by both sides. I agreed to take so much out of the building each month. Due to illness I missed a couple of weeks over one years time. However according to our I was to have until December 31, 2002 vacate the premises. The buyer decided that I was not moving the material quickly enough and took it upon himself to remove it. He is now suing me for the cost of the removal. He also took storage trailers that I had on the property and emptied them of my merchandise and filled them with his. Cut the locks etc. I want to file a counter suit because as I see it he owes me much more than his claim against me. I am 73 years old and the lawyers that I have contacted want retainers that I just can't raise. Is there a way that I can answer this suit he has filed against me without legal counsel. Thanks so much, Val Chiaradonna

Hello,

Your rights are going to be based on the agreement with the other party.

Is there a way that you can answer this suit he has filed against you without legal counsel? This question I can't answer because I am a lawyer. If I gave advice on a question like that in a forum like this, I would have malpractice exposure without any benefit.

In my opinion, you are going to need to hire a lawyer. You are a businessperson. Some lawyers might be interested in discussing differing fee arrangements but no sensible lawyer will do your work for nothing.

The final point I want to make is that you face strict time deadlines. You need to get legal advice immediately.

Best wishes with a difficult problem, but you are going to have to pay to fix it.
