Legal Question in Health Care Law in Massachusetts

Obtaining My Medical Records

I had a personality conflict with my Primary Care Physician. I have since changed physicians. I have asked my ex-PCP for my medical records, in writing, twice. It has been almost 2 months and I have not received any word from him. Do I have any legal recourse?

Re: Obtaining My Medical Records

1. Send a letter to the doctor requesting access to and a copy of your records under 243 CMR 2.07 (13)(b).

2. Send a letter to the Board of Registration in Medicine stating that your physician has denied your requests for access and a copy of your records.
