Legal Question in Immigration Law in Massachusetts

Hi,

i am a US citizen and would like to file for my husband who is already in the US, entered without inspection in 2001. His mom filed in 2001 as a skilled worder, when there was last immigration law was out. since he reached the age limit, his name was not listed under dependent child in I130. his mom's I140 hasnt been approved as of yet. Is there any way i can apply for him?

Unfortunately since he entered without inspection if you file for him you will have to put together a hardship waiver. This is not something you should try and do yourself. You really need to consult with an immigration attorney to assist you and also find out what's happening with his mom's I-140.
