Legal Question in Immigration Law in Massachusetts

Hi,

A friend of mine has got his I-490 approved and is currently waiting for his priority date for I-485. His wife was arrested few years ago for a shoplifting charge and the case was dismissed with continuance without a finding.

The question is will this affect their I-485 application. Will the green card application be rejected. Is there any waiver form which they can fill and help in their application.

First who is the sponsor and who is adjusting status...your friend of the wife? If the wife who got arrested for shoplifting is the one who is applying for the green card then the criminal case will probably come up, although it will really depend on her criminal history. If your friend is the person who is applying for the green card, and the wife is a US citizen, the her arrest should really not affect the outcome, but the Officer may raise some questions about it at the interview stage.
