Legal Question in Insurance Law in Massachusetts

life insurance policy

my mother died in December of 2005, I am trying to collect on her life insurance policy, but the insurance company says she never named a beneficiary on the policy. also, there is no executor, they need an executor to name me her beneficiary. what is the proper channel to go through to get this claim settled? they will close this claim soon if I don't get this done. My mother died in Florida, and I live in Mass. I would prefer not to hold this up any longer than it already has. any information will be helpful, thanks,

Re: life insurance policy

If your mother never named a beneficiary, then only her administrator (appointed by a probate court) can do so on her behalf once she has passed away. you will need to open a probate estate for what I assume are very limited purposes (ie. most of her assets have probbaly been conveyed de factor, or were non-existent). Please contact our office if you would like us to handle this for you.
