Legal Question in Employment Law in Massachusetts

Is it legal for a company to ask a potential hire (I work with students at a university) for their social networking links: twitter, blog, myspace, facebook, linkedin etc.

Generally, an employer may make inquiry of his potential employee as to any subject, subject to various state & federal laws ( an employer may not inquire as to your race, color, creed, sexual orientation,disabilities, medical history, subject to certain exceptions such as the bona fide occupational exception etc).

I don't see any legal problem with the inquiry, but frankly I am not sure. I just have never heard of a company requesting such information nor of any law prohibiting such an inquiry. From your question, I am not sure if you are with the employer or the employee. Regardless, every young person these days should be aware that any potential employer is going to check them out on-line, including their profiles on Twitter, Facebook, and Myspace. If you are a potential employee, I would make sure you clean up what can be found online. If you are an employer, I would not ask for their links, but, in researching a potential hire, I would review the pages online to the extent you can.
