Can i sue my employer for causing undo finacial hardship and setback that has cause emotion distress on me and my family?

Without knowing the reason for suing your employer, no one can respond to your question intelligently. Wrongful termination, sexual harrassment, racial bias, and numerous other claims could include a claim for emotional distress. Violation of overtime rules and oncall rules could also weigh on a claim. However, suing a boss for being a jerk or the fact you do not earn enough working for him/her/it is not a grounds for a suit. I am not sure what the financial set-back is, so I cannot answer your question. If he layed you off for lack of work, absent a claim that the lay-off was for impermissable reasons, there is not much you can do. If you are layed-off you can seek unemployment. If your unemployment is exhausted, all you can do is look for a new job or try to get something else.
