Legal Question in Employment Law in Massachusetts

Time off payment after quitting

My brother needed to take some time off after his baby was born. He asked his employer how much time off he had available and was told he had 3 weeks (he was told this in writing via fax). He took the 3 weeks off and, during this period, was offered and accepted a new job. When he returned to work and gave his notice of leaving, he was told to ''go home'' on that day. Here's the problem: The company did 2 things....First, they somehow took back $2,000 that had already been direct-deposited to his bank..payment for some of the time off. Second, they sent him a letter saying he owes them $4,000 for some taxes that they payed because he did not accrue enough time. But he only took what they said, in writing, what they said he could take. I think they are changing the rules of vacation time because he quit. Any info would be greatly appreciated.

Your brother may have a claim for discrimination, but may not. Contact the Massachusetts Commission Agaijnst Discrimination. If no claim there, contact the Attorney General's office, Wage and Hour Administration, they may be able to help you.
