Legal Question in Landlord & Tenant Law in Massachusetts

How do i evict a temporary roommate who refuses to move and has not paid rent for 2 months and has agreed in front of my landlord, and another tenant that he would move out at end of this month of July? I have discussed this with him last night and he more or less has no intentions on moving out, although i have sent him an notice to vacate by certified mail.

You file a Summary Process action to evict him for non-payment of rent. He either pays or you get him out. You must first give him a 14 day notice to pay or move. You need to indicate he is a co-tenant or a sub-tenant as the case may be and ask the court to order him to pay the arrears and move out. You can get the form from housing court or district court depending where you are.

Good luck.
