Legal Question in Landlord & Tenant Law in Massachusetts

I moved into the house I live on December 1st, 2008. E couple months ago, when my contract was going to expire, I noticed that during the whole moving situation back in December, the landlord never game a copy of the contract. When I asked her for one, she did not have it. When I told her that it was a necessity, she never gave me the original one, she gave me a ridiculous copy that even had a crossed out "X" in black pen over the year I moved, and also, the contract says I moved on Jan 1st, 2009. I was shocked and decided to wait a while before I confronted her, because she is a a woman who likes to take the course of all thing to her advantage, so, I just let it be, and I am now living the extra month here. During the time I was living here, I asked her to paint the apartment, and she let me do it on a "mouth contract" and she has been here many times and never said anything. Today, when I called her to say I was going to live on my deposit, she called back and left a message and said it was absolutely unacceptable that I live don the deposit, and that I had one more month to live here, and that I needed to pay rent right away. And she started saying that she wanted the apartment the way it was. Now, my question... is it legal for her to tell me and my roommate we can't live on the deposit? And is it illegal that she never gave me a copy of the contract and this one is all messed up?

Depends-what does the lease say about the deposit? Does it say the deposit can be used for the last months rent or that it may not be used? Remember the lease would control as this is a property issue.
