I received a 14 day notice to quit on 2/17/11 - rent was only due for 2/1/11 - now served with eviction process by sheriff...my question is with regards to the 14 day notice - doesn't this have to be done when I am 30 days or more behind on rent and would it be considered retaliation since I just paid 7 months of back rent...

If you are one day late with rent your landlord can serve a 14 day notice to quit. If it a residence and this is the first 14 day notice in a year, the landlord must include in the notice that the tenant has 10 days to bring the rent current. If rent is brought current within the 10 days, the 14 day notice is no longer valid.
