return of security deposit

my daughter and her ex-boyfriend split up. she is still living in their apt, they had together with her 8 month old baby. he left the apt at the end of oct. their lease was up the following march. she is still going to stay in the apt. as teneant at will. The ex boyfriend is demanding from the landlord his security deposit back. Is the landlord obligated to return any monies to the ex-boyfriend??

Without more detailed information,it is hard to say. In general, the landlord is required to return the security deposit (plus interest) at the end of the tenancy, minus any deductions for repairs beyond normal wear. However, whether or not the ex should get the security deposit back may depend on several things: Did the ex pay the security deposit? Was the apartment in good condition at the end of the lease period? Whose name was on the lease? Has the tenancy actually ended, or is it continuing because your daughter is still renting the apartment?
